Terms and Conditions for HECT India

Welcome to HECT India. We offer a wide range of travel-related services, including Hotel Booking, Flight Booking, Tour Packages, Excursions/Attractions, Airport Transfers, and Travel Insurance. The following Terms and Conditions outline the rules and responsibilities governing the services provided by HECT India. By using our services, you agree to comply with these terms.
1. Services Overview
HECT India offers travel services globally, including but not limited to:
- Hotel Booking
- Flight Booking
- Custom Tour Packages
- Excursions and Attractions
- Airport Transfers
- Travel Insurance
Each of these services is subject to the terms outlined below. Please review these terms carefully before making a booking.
2. Pricing & Availability
a. Dynamic Pricing:
All rates mentioned on our website and in our packages are subject to change at any time due to several factors, including:
- Hotel availability
- Seasonal variations
- Peak season or festival surcharges
- High demand periods
Pricing adjustments may occur at the time of booking, and any changes will be communicated to you before confirming your booking. Once the booking is finalized, the agreed-upon price will remain fixed unless extraordinary circumstances arise (e.g., fuel surcharges, government taxes). HECT India reserves the right to amend package prices if these factors influence the overall cost of your trip.
b. Currency Exchange:
For international bookings, prices may fluctuate depending on exchange rates. All payments should be made in the currency stipulated by HECT India. HECT India is not responsible for any discrepancies in exchange rates applied by your credit card company or bank.
3. Hotel Substitutions (Tour/Holiday Packages)
a. Hotel Availability:
The hotels listed in our tour packages are based on availability at the time of booking. If the desired hotel is unavailable due to full capacity, booking restrictions, or any other reason, HECT India will arrange an equivalent or superior accommodation. We will make every effort to provide accommodations that match the original booking in terms of location, amenities, and quality.
b. No Guarantee of Hotel Choice:
While we strive to book hotels as per your preference, HECT India cannot guarantee specific hotels due to the dynamic nature of hotel reservations and market conditions. In rare cases where similar accommodations are unavailable, HECT India will inform you in advance and provide alternative options for your consideration.
c. Hotel Check-In & Check-Out:
Check-in and check-out times are determined by the respective hotels and may vary from one property to another. Early check-in or late check-out requests are subject to hotel policy and may incur additional charges. Please check with the hotel directly upon arrival.
4. Responsibility for Cancellations
a. Third-Party Cancellations:
HECT India is a travel facilitator, and we rely on third-party providers such as airlines, hotels, and excursion operators. In the event of a cancellation by a third party due to circumstances beyond our control (e.g., natural disasters, government regulations, airline suspensions), HECT India will not be liable for the cancellation itself but will assist in coordinating alternatives where possible.
b. Force Majeure:
HECT India shall not be held responsible for cancellations or disruptions resulting from force majeure events, which include but are not limited to natural disasters (earthquakes, floods, hurricanes), war, civil unrest, pandemics, governmental orders, or other unforeseen events. In such cases, refunds will depend on the terms of the third-party providers, and HECT India will not be obligated to offer compensation beyond the service provider's policy.
c. HECT India’s Cancellation Policy:
If HECT India must cancel your trip for any reason other than force majeure (such as insufficient bookings or unforeseen company issues), we will notify you at the earliest and offer a full refund or the option to book an alternative package.
5. Extended Stay Due to Unforeseen Events
HECT India will not be held responsible for any extended stay required due to circumstances beyond our control, such as:
- Natural disasters
- Health-related issues
- Flight cancellations
- Political unrest
Travelers are advised to be financially prepared for such disruptions and to secure adequate travel insurance that covers extended stays due to emergencies. All costs incurred for additional accommodation, meals, and other expenses during extended stays are the responsibility of the traveler.
6. Travel Insurance
a. Mandatory Recommendation:
HECT India strongly recommends that all travelers purchase comprehensive travel insurance to protect against potential risks, including:
- Medical emergencies
- Flight cancellations or delays
- Loss or theft of belongings
- Trip cancellations
By opting out of travel insurance, travelers assume full responsibility for any disruptions or issues that may arise during their journey, including but not limited to health problems, loss of documents, or flight cancellations. HECT India will not be held liable for any damages or losses that could have been covered by travel insurance.
b. Travel Insurance Responsibility:
In case of events such as flight cancellations, rescheduling, or emergencies, the insurance provider will be responsible for providing a solution. HECT India will not be accountable for resolving such issues but will offer guidance on the insurance claims process where applicable.
7. Flight Cancellations or Rescheduling
a. Airline Policies:
Flight cancellations, rescheduling, or suspensions are governed by the terms and conditions of the airline. In the event of a cancellation or rescheduling by the airline, HECT India will not be responsible for any costs or disruptions incurred. The airline and the travel insurance provider will handle compensation, rebooking, or refund requests.
b. Airport Transfers and Flights:
HECT India will provide airport transfers as per the scheduled arrival and departure times of your flights. In the event of a significant delay or rescheduled flight, HECT India will assist in coordinating new transfer arrangements where possible. However, additional costs incurred due to last-minute changes or delays are the responsibility of the traveler.
8. Vehicle Issues During Tours
In the event of any mechanical issues with the tour vehicle (e.g., tire problems, breakdowns), the driver and our team will make every effort to resolve the situation efficiently and with minimal disruption to the tour. We will aim to provide a replacement vehicle where necessary.
However, unforeseen vehicle issues may cause delays, and HECT India will not be held liable for any missed attractions, excursions, or services resulting from such events. We appreciate your understanding and patience in these rare occurrences.
9. Shared Transfers & Delays
a. Shared Transfers:
For shared transfers or pickups, travelers are required to be ready and waiting in the hotel lobby at the scheduled time. Delays in reaching the pickup point may result in the missed transfer or tour, and such missed services will be non-refundable and non-adjustable.
b. Traffic and Unforeseen Delays:
While we aim to adhere to the scheduled pickup times, road traffic, weather conditions, or unforeseen events may cause delays. In such cases, HECT India will not be responsible for missed tours or transfers due to these delays, and no refund or compensation will be provided.
10. Excursions and Attractions
a. Third-Party Excursions:
HECT India offers a variety of excursions and attractions through trusted third-party providers. These include city tours, adventure activities, cultural experiences, and more. While we ensure the highest standards in our offerings, we are not responsible for the operational issues or cancellations caused by the third-party operators.
b. Excursion Cancellations:
Excursions may be canceled due to adverse weather, insufficient bookings, or other factors beyond our control. In such cases, HECT India will provide an alternative excursion where possible or arrange a refund, depending on the provider’s cancellation policy.
11. Client Responsibilities
a. Documentation:
It is the client’s responsibility to ensure they have all necessary travel documents (passport, visa, tickets, etc.) before embarking on their journey. HECT India will provide guidance on visa requirements, but securing the visa and adhering to destination-specific regulations is the client’s responsibility.
b. Health and Fitness:
Clients are responsible for ensuring they are physically fit to participate in the tours and activities booked. If any medical conditions may affect your participation, please inform us in advance. HECT India is not liable for any health-related issues that arise during the trip.
c. Behavior and Conduct:
Clients are expected to behave in a respectful manner during the tour and follow local laws and customs. HECT India reserves the right to terminate the tour of any client who engages in inappropriate or illegal behavior, without any refund.
12. Complaints and Disputes
If you encounter any issues during your trip, please notify HECT India as soon as possible so that we can address and resolve the matter. Complaints received after the trip has concluded will be investigated, but HECT India’s liability will be limited.
13. Modification of Terms
HECT India reserves the right to modify these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website. We encourage clients to review these terms regularly to stay informed of any updates.
14. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
